Terms of Service

These Terms of Service (the “Terms”) are a binding agreement between you and Symflip (“Symflip”, “we”, “us”, or “our”) governing your access to and use of the Symflip deployment platform, websites, APIs, and related services (together, the “Service”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
Symflip is a hosted, agentless deployment platform that connects to your Git repositories and Linux servers to perform zero-downtime releases, stream deploy logs, and provide one-click rollback. We may add, change, or remove features over time. We do not host your application or store your source code permanently; we orchestrate deployments to infrastructure that you control.
2. Eligibility and accounts
You must be at least 18 years old, or the age of majority in your jurisdiction, and able to form a binding contract. You are responsible for the accuracy of your account information, for safeguarding your credentials, and for all activity that occurs under your account. Notify us promptly at legal@symflip.com of any unauthorized use. You may not share your account or transfer it without our consent.
3. Acceptable use
You agree not to, and not to permit anyone to:
- use the Service to deploy to, access, or interfere with systems you are not authorized to control;
- violate any law, regulation, or third party’s rights, including intellectual property and privacy rights;
- upload or transmit malware, or use the Service to attack, disrupt, or gain unauthorized access to any network or system;
- reverse engineer, decompile, scrape, resell, or create derivative works of the Service except to the extent this restriction is prohibited by applicable law;
- probe, circumvent, or overload our infrastructure, rate limits, or security controls; or
- use the Service to send spam or unlawful, harmful, or infringing content.
We may suspend or terminate access for conduct that violates these Terms or that we reasonably believe risks harm to the Service, us, or others.
4. Your content, repositories, and servers
You retain all rights to your source code, configuration, secrets, and the servers you connect (“Your Content”). You grant us a limited, non-exclusive license to access and process Your Content solely to operate and provide the Service to you — for example, to connect over SSH, build a release, and stream logs. You are solely responsible for Your Content, for maintaining backups, and for the security and lawful operation of your own repositories and servers. You represent that you have the authority to connect them.
5. Plans, billing, and payment
The Service is offered under free and paid subscription plans. Certain features, usage limits, and levels of support are available only on paid plans, and we may change which features belong to which plan.
- Fees and billing cycle. Paid plans are billed in advance on a recurring basis (for example monthly or annually) at the price shown at the time of purchase, plus applicable taxes.
- Automatic renewal. Subscriptions renew automatically for successive periods unless you cancel before the end of the current period. You authorize us and our payment processor to charge your payment method for each renewal.
- Payment processing. Payments are handled by a third-party payment processor; we do not store full payment card details. Your use of payment features is also subject to the processor’s terms.
- Price changes. We may change prices or plan features. We will give you reasonable advance notice, and changes take effect at your next renewal. Continuing to use a paid plan after a change takes effect constitutes acceptance of the new price.
- Taxes. Fees are exclusive of taxes, which you are responsible for except for taxes on our net income.
- Non-payment. If a charge fails or an account is past due, we may downgrade, suspend, or terminate paid features until amounts owed are paid.
6. Free plans and trials
Free plans and trials are provided as-is and may be modified, limited, or discontinued at any time. We may set usage limits and may end a trial or free plan at our discretion.
7. Cancellation and refunds
You may cancel a paid plan at any time from your account; cancellation takes effect at the end of the current billing period, and you retain paid access until then. Except where required by law, fees already paid are non-refundable and we do not provide refunds or credits for partial periods.
8. Third-party services
The Service integrates with third parties you choose, such as Git providers and your hosting infrastructure. We are not responsible for third-party services, and your use of them is governed by their own terms and privacy practices.
9. Intellectual property
The Service, including its software, design, and trademarks, is owned by Symflip and its licensors and is protected by intellectual property laws. Symflip is proprietary software and is not open source. We grant you a limited, non-exclusive, non-transferable, revocable right to use the Service in accordance with these Terms. No rights are granted except as expressly set out here. If you send us feedback, you grant us a perpetual, royalty-free license to use it without restriction.
10. Disclaimers
The Service is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any deployment will succeed. You are responsible for testing releases and maintaining your own backups and recovery procedures.
11. Limitation of liability
To the maximum extent permitted by law, Symflip and its suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or relating to the Service or a failed or unintended deployment. Our total aggregate liability for any claim relating to the Service will not exceed the greater of the amounts you paid us for the Service in the twelve months before the event giving rise to the claim, or fifty (50) US dollars.
12. Indemnification
You agree to indemnify and hold harmless Symflip from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Service, Your Content, your servers, or your violation of these Terms or any law or third-party right.
13. Suspension and termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms, fail to pay, or if we reasonably need to protect the Service or others. On termination, your right to use the Service ends and we may delete your account data in accordance with our Privacy Policy. Sections that by their nature should survive termination will survive.
14. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will provide reasonable notice, such as by email or a notice in the Service. Changes take effect on the date stated, and your continued use after that date constitutes acceptance.
15. Governing law and disputes
These Terms are governed by the laws of the Netherlands, without regard to its conflict-of-laws rules. The courts located in the Netherlands will have exclusive jurisdiction over any dispute, subject to any mandatory consumer protections available to you where you live.
